Art & Decor – Home Concept sells products that benefit from the legal guarantee of conformity provided for in Decree-Law No. 84/2021, of October 18, and other applicable legislation.

Where a product has a lack of conformity at the time of delivery, the consumer benefits from the rights provided for by law and may, depending on the circumstances and applicable legal requirements, request the restoration of conformity of the goods by repairing or replacing them, an appropriate reduction in the price or termination of the contract.

The duration of the legal warranty varies according to the nature of the asset and the applicable legal regime, under the terms of the legislation in force.

Art & Decor – Home Concept is committed to analyzing each situation diligently and ensuring compliance with the legally recognized rights of consumers.

The legal warranty covers only non-conformities covered by the applicable legislation, without prejudice to any additional commercial guarantees that may be made available by the manufacturer or by Art & Decor – Home Concept.

 

  1. Warranty Exclusions

The legal guarantee of conformity does not cover defects, damages or anomalies resulting from causes subsequent to the delivery of the product or that are not attributable to Art & Decor – Home Concept or the manufacturer.

Without prejudice to the legally recognized rights of the consumer, the following situations are considered, in particular, excluded from the warranty:

  • Damage resulting from improper use, negligent or contrary to the instructions for use and conservation of the product;
  • Normal wear and tear resulting from regular use of the product;
  • Damage caused by impacts, falls, scratches, cuts, punctures or other accidental actions;
  • Alterations, repairs, dismantling or interventions carried out by unauthorised persons;
  • Use of inappropriate, abrasive or chemically aggressive cleaning products;
  • Damage caused by prolonged exposure to direct sunlight, excessive humidity, extreme temperatures, water, steam or other unsuitable environmental conditions;
  • Damage resulting from transportation, assembly or installation carried out by the customer or by third parties hired by the customer;
  • Use of the product for purposes other than those for which it was designed or outside the manufacturer's technical specifications.

In the case of products made with natural materials, namely wood, natural stone, marble, ceramic, leather or natural fabrics, small variations in colour, shade, texture, veins, knots, pores, dimensions or finish are characteristics of these materials and are not considered manufacturing defects or lack of conformity.

Likewise, there may be slight differences between the photographs presented on the website and the product actually delivered, namely in terms of the shade of the colours, depending on the lighting used, the characteristics of the materials or the screen settings of the device used by the customer, and these differences do not constitute a lack of conformity.

Whenever there are specific instructions for use, maintenance or conservation provided by the manufacturer, these must be respected, prevailing over the general recommendations contained in this policy when applicable.

 

  1. How to Claim the Warranty

If the customer considers that the product has a lack of conformity covered by the legal warranty, he should contact Art & Decor – Home Concept as soon as he is aware of the situation, through the contact means provided for this purpose.

The request for assistance shall, where possible, be accompanied by the following:

  • Customer identification;
  • Order or invoice number, or other proof of purchase;
  • Product identification;
  • Detailed description of the verified situation;
  • Photographs or videos to assess the lack of conformity, where possible.

Upon receipt of the request, Art & Decor – Home Concept will analyze the situation and may request additional information or elements that it deems necessary for the correct assessment of the occurrence.

Whenever necessary, the collection, inspection or return of the product may be requested, in order to allow the technical verification of the alleged lack of conformity.

Once the analysis is completed, Art & Decor – Home Concept will inform the client of the decision adopted and the legally applicable solutions, under the terms of Decree-Law No. 84/2021, of October 18th.

The client undertakes to collaborate with Art & Decor – Home Concept during the process of analyzing the occurrence, providing the information reasonably necessary for the assessment of the request.

 

 

 

  1. Receipt and Verification of Products

At the time of delivery, the customer must check, whenever possible, the condition of the packaging and the products received, confirming that they correspond to the order placed and that they do not have visible damage resulting from transport.

If apparent damage, visibly damaged packaging, missing products or any other irregularity are detected, the customer should, whenever possible:

  • Indicate the occurrence in the carrier's delivery document, when applicable;
  • Record photos of the packaging, the product and the damage verified;
  • Communicate the situation to Art & Decor – Home Concept as soon as possible, through the contacts made available for this purpose.

Whenever there is damage that is not visible at the time of delivery, but detected only after opening the package, it is recommended that the customer communicates this situation to Art & Decor – Home Concept as soon as he or she becomes aware of it, attaching, whenever possible, photographs or other elements that allow the respective evaluation.

The timely communication of damages or irregularities allows for a faster analysis of the occurrence and facilitates coordination with carriers, manufacturers or other entities involved, without prejudice to the legally recognized rights of the consumer.

Art & Decor – Home Concept will analyze each situation individually, seeking to ensure an adequate solution and in accordance with the applicable legislation.

 

 

 

 

  1. General Recommendations for Use and Conservation

The products marketed by Art & Decor – Home Concept are selected according to high quality standards. However, its durability, functionality and appearance depend, to a large extent, on the correct use, maintenance and conservation by the customer.

To preserve the characteristics and extend the shelf life of the products, it is recommended to observe the following guidelines:

General Recommendations

  • Use the products exclusively for their intended purpose;
  • Follow the instructions for use, assembly and maintenance provided by Art & Decor – Home Concept or the manufacturer, when applicable;
  • Carry out regular cleaning using only products suitable for the type of material;
  • Avoid the use of abrasive products, solvents, bleaches, alcohol or other chemical agents that may damage the finishes;
  • Protect surfaces against scratches, impacts and excessive loads;
  • Avoid dragging furniture, and it is recommended that it be lifted during its movement;
  • Use protective bases for hot, damp or sharp objects placed on worktops made of wood, stone, glass or other sensitive materials.

Environmental Conditions

In order to preserve the stability and good condition of the materials, it is also recommended that the products:

  • Are not exposed to direct sunlight for a long time;
  • Be kept away from intense sources of heat or cold, such as fireplaces, stoves, radiators, air conditioners or heaters;

These characteristics do not affect the quality, functionality or durability of the products and, for this reason, do not constitute manufacturing defects or lack of conformity covered by the legal warranty.
